Seit Jahren versuche ich, ein Verzeichnis der vorhandenen
Gerichtsakten aufzustellen. Die Liste unten führt auf, was
ich bisher habe. Wer kann diese Liste ergänzen?
Gesucht werden Lagerort (AP Danzig,Bromberg,Allenstein,Thorn usw),
Zeitraum,Signaturen, sowie Umfang der Deposituren/Bände.
Die Gerichtsakten sind wegen der dort vorhandenen
Grund- und Hypothekenakten, Waisenakten usw. von Interesse.
Eingerichtet wurden Grund- und Hypothekenakten in Preußen allgemein
mit der Preußischen Hypothekenordnung von 1783.
Man nannte das Gericht damals Domainen-Justizamt (1783-1806), Land- und
Stadtgericht (1806-1849), Kreisgericht (1849-1879),Amtsgericht (ab 1879).
The whereabouts of the records for the Landgerichte is unknown.
Some deed records of the Amtsgerichte are deposited at the Gdansk, Bydgoszcz,
Elblag, Olsztyn, Szczecin, Torun archives today, or remained in the
regional court archives. Of special interest are the land deed
records (Grund- und Hypotheken-Acta) with no published survey known.
These records usually start with a land title history (=tituli
possessionis) going back 50 or more years from the beginning
of the first deed book (1782). Legal basis for these land records
is the Prussian Hypotheken-Ordnung of 1783.
The court was called Domainen-Justizamt (1783-1806), Land- und Stadtgericht
(1806-1849), Kreisgericht (1849-1879), Amtsgericht (since 1879).
Other court records are Erbrezesse, Erbvergleiche (probates),
Pupillenakten (orphan records), last testaments and wills,
Erbscheine which usually are added as Beilage-Acten to the
Hypotheken-Acta.
A remarriage of a widower/widow was always documented in the
Amtsgericht
(Sad Obwodowy) stating in detail the estate rights of surviving
children as well as rights and duties of parents and step parents.
This is a source at the Amtsgericht which is widely unknown and
untapped (and unfilmed by the LDS).
The purpose of this note is to ask your cooperation in locating
missing court records and to compile an inventory of court records in
the Kwidzyn district. What I have compiled so far, is listed below.
